California sues automakers over global warming
SAN FRANCISCO September 20, 2006 10:20am • Claims vehicle emissions costing taxpayers, environment • ‘Time to hold companies responsible’
California on Wednesday filed a lawsuit against the largest U.S. and Japanese automakers, alleging their vehicles’ emissions have contributed significantly to global warming, harmed the resources, infrastructure and environmental health of California, and cost the state millions of dollars to address current and future effects.
“Global warming is causing significant harm to California’s environment, economy, agriculture and public health,” says state Attorney General Bill Lockyer in written comments announcing the lawsuit. “Vehicle emissions are the single most rapidly growing source of the carbon emissions contributing to global warming, yet the federal government and automakers have refused to act. It is time to hold these companies responsible for their contribution to this crisis.”
Filed in U.S. District Court for the Northern District of California, the complaint names as defendants Chrysler Motors Corp. (a unit of DaimlerChrysler AG of Stuttgart, Germany (NYSE: DCX); General Motors Corp. (NYSE: GM); Ford Motor Co. (NYSE: F); Toyota Motor North America Inc., a unit of Toyota Motor Corp. of Tokyo (NYSE: TM [ADR]); Honda North America, a unit of Honda Motor Co., Ltd. of Tokyo (NYSE: HMC [ADR]); and Nissan North America, a unit of Nissan Motor Co., Ltd. of Tokyo (NASDAQ: NSANY [ADR]).
The lawsuit is the first of its kind to seek to hold manufacturers liable for the damages caused by greenhouse gases that their products emit.
The complaint alleges that under federal and state common law the automakers have created a public nuisance by producing “millions of vehicles that collectively emit massive quantities of carbon dioxide,” a greenhouse gas that traps atmospheric heat and causes global warming.
“Global warming has already injured California, it environment, its economy, and the health and well-being of its citizens,” the complaint says.
Earlier, in a separate action, automakers filed suit against the state of California, claiming state emissions regulations are pre- empted by federal law.
I mean, why stop there? How about suing Isaac Newton's Heirs for discovering gravity and causing wrinkles and the drooping titties that plague the aging glitterati lurking on Sunset Boulevard? Hell, just ban all cars and get it over with. And let's eliminate fast food, alcohol, sex, loud music and all the other things that might cause deleterious damages to the 30 million wimpy west coast wusses that elect these legal morons.
