Diffuser design and ease of overtaking

The Speed commentators were saying that the double level diffusers make
pasing more difficult-they say the air is disturbed which negates what the
Sporting Regulations attempted to do-make overtaking easier-in this example.
So, why did the Court of Appeal decide to declare the diffusers used by
Williams, Toyota, and Brawn not in violation?  Maybe they didn't violate the
letter of the law, but, given the information above, I would say they
certainly violate the spirit.  Now, when everyone gets their modified
diffusers on their cars, overtaking will, according to what I heard during
the Bahrain Grand Prix, more difficult.  More difficult than last year?
Don't know.  More difficult than was planned for this season?  Yep.
So...?
