Believe me, Uncle Ken 'knoweth of what he spreaks.' All I got when 'The Little 
Lady' and I finally split up?was what I either found in the trash barrels in 
front of her (used to be our) house and my clothes, which she dumped out in the 
middle of the street in front of where I was then living. The net result was 
instead of my goal of retiring when I reached 50, I retired at 59. Was it worth 
it? You bet your sweet ass it was! Life has been a real rollercoaster, but it's 
been a hell of a ride!

Texas is a community property state. She gets the property, you leave  
the community. When it's happening to you, you are not able make  
informed and objective decisions until long after the chips are  
already down. She may have obtained representation before she even  
called the movers. Protect yourself. Get the best damn lawyer you can  
afford. Do whatever he says.

An observation from the trenches: Once the dusts settles somewhat  
attorneys tend to drag things out for years as long as the checks  
keep flowing. Unless you enjoy  repetitive interrogatories and  
constantly producing your books for inspection it is far, far better  
to bite the bullet and settle than to go to trial. Trial is prolonged  
and expensive. My record was five years. You pay the bills for both  
sides.

When the nut-cutting comes, give  her more or less what property she  
wants and walk away. Fights will go on until the lawyers have  
everything, the child is grown and your business is reduced to ashes.  
You still have to make a  living, all she has to do is get divorced.   
If I could change one thing in my past I would have insisted on a  
prenup.

As far as the boy goes the courts will always side with the mother  
unless she can be shown to be unfit, which if she hasn't robbed any  
banks lately you are out of luck. It stinks but in the end that's how  
it always seems to come down.

Forget squabbling, or revenge, Your goal must be to put this behind  
you quickly and expeditiously, with minimum damage, and get on with  
your life. Unexpected separation and divorce is like a death in the  
family, you go through the five stages of grief. Meanwhile, take good  
care of yourself - we have all been there one way or another - it's  
just a part of the mysterious process called 'life'.
