In a message dated 3/17/2008 5:16:25 A.M. Central Daylight Time, ferrari-request [at] ferrarilist.com writes: When is a Ferrari no longer a Ferrari? When an owner adds 6-ft of metalwork between the front and back of the prancing stallion, Ken: You don't know where there is a web photo of that car, do you? I'd really like to see the look of it. IMNSHO, and subject to the disclaimers below, I'm not sure Ferrari would prevail if they did take him to court. In some jurisdictions they might be found to have filed a frivolous lawsuit and end up paying his attorney's fees as well as their own, and also paying a dealer to reinstall any of the parts that were removed. You hit the nail on the head, he paid for the car and it belongs to him. He bought the Ferrari emblems with the car and they belong to him as well. And if his title still calls it a Ferrari that is what the car legally is and the folks from the factory may not like it, and may not be liable is a component fails but that should be where the process ends. I cannot recall the name of the U.S. warranty law, "Magnuson" something if my aged brain is not too confused, but I think that under our law it would be incumbent upon them to show that the modification caused the failure of any part under warranty or they would pay for the warranty repairs as well. Now, I can't speak for the U.K. but in the worst case he ought to ship it to the right U.S. jurisdiction and then just dare them to say something about it. If you can afford to add that much to a 360 the shipping and title fees should be no step for a gentlemen of such means.
