Robert,

your car is a 328, right?

That means the valve is stuck open, which is the normal position when cold. You can remove it and try to clean it. Doesn't hurt to try!!
When working normally, even if the 12V are not present it should close after warming up. You can try to heat it and see if it closes.

If it doesn't work you can try a Bosch shop for part number 0 280 140 168 (auxiliary air valve )
