I've heard this before - to me, certainly no expert - it would still be 
theft - theft by fraud.  Afterall, when you let someone testdrive a car the 
understanding is you;ll either get the car back or a bag of money.  Of 
course,  not being a lawyer or congressional lawmaker I tend to rely on 
logic more than those who make and prosecute our laws do. ;-)
